ABOUT THE CHAMBER OF ADVOCATES...

Presidential Decree "On measures to further reform of the legal profession in the Republic of Uzbekistan" May 1, 2008 approved the proposal of the Ministry of Justice and the Association of Advocates of Uzbekistan about the establishment of the Chamber of Advocates of the Republic of Uzbekistan on the basis of the Association of Advocates of Uzbekistan, based on compulsory membership of all attorneys of the Republic of Uzbekistan.

The Chamber of Advocates of the Republic of Uzbekistan was formed in succession on the basis of the Association of Advocates of Uzbekistan and its regional branches on the basis of a founding conference from September 12, 2008.

In September 2013 there was held the II Conference of Chamber of Advocates of Uzbekistan, during which were ratified such documents of Chamber of advocates as Charter, Regulation on revision commission, Attorney’s professional ethics rules in new editions, were elected members of our Chamber (executive body) and revision commission.

The above-mentioned presidential decree has identified the most important tasks and activities of the Chamber of Advocates as following:

– the implementation of centralized coordination of attorney formations;

– promotion further development of the profession of attorney, enhance its credibility, strengthening the role of the legal profession in the protection of human rights and freedoms;

– implementation of measures on legal advocacy aimed at improving the legal awareness and legal culture of the population;

– making proposals for improving the legislative framework and law enforcement reforms, ensure the integrity of legal regulation and the uniformity of application of the legislation;

– participation in the drafting of legal acts regulating the activities of advocacy, preparation of proposals on them;

– representation and protection of the rights and legitimate interests of attorneys, including in relations with the state and economic management, as well as in court;

– adoption of measures to protect lawyers from persecution, restrictions and harassment in connection with their professional activities;

– provision of training and further training of attorneys;

– ensuring access to legal aid through the establishment of legal advices in the areas and towns of the republic;

– the collection and study of statistical data on the activities of advocacy, dissemination of positive experience of lawyers, law firms providing methodological assistance;

– monitoring the compliance by attorneys with laws and professional ethics rules.

In accordance with the decree of the Cabinet of Ministers by April 16, 2009 № 166-p the building located at: 471, Buyuk Ipak Yuli street, Mirzo Ulugbek district, Tashkent, was given to the balance of the Chamber of Advocates of the Republic of Uzbekistan free of charge, without the right of disposal.

In accordance with the Resolution of the Cabinet of Ministers by December 9, 2009 "On additional measures to strengthen the material-technical base of the Chamber of Advocates of the Republic of Uzbekistan" №308, for the repair and reconstruction of the administrative building of the Chamber of Advocates has been allocated 820 million sums from the Development Fund of the courts and judicial bodies.

 

 

Since its establishment, the Chamber of Advocates have done extensive work aimed at further reforming and improving the activity of the advocacy institution in the Republic of Uzbekistan.

In 2009, the Chamber of Advocates organized and conducted re-certification of all attorneys carrying out their activities in the Republic of Uzbekistan to 1 January 2009 for compliance with the requirements established by the Presidential Decree of May 1, 2008, №PD-3993 "On measures for further reformation of the advocacy in the Republic of Uzbekistan".

 

Legislative activity

One of the important activities of the Chamber of Advocates is to participate in legislation aimed at reforming the judicial legal system of the Republic of Uzbekistan.

In the process of reform of the legal profession in the Republic of Uzbekistan with the active involvement of the Chamber developed and adopted a number of legal acts in the following areas:

– On activities of the Chamber of Advocates

– On activities of law firms

– On attorneys’ activities

– Other.

On activity of the Chamber of Advocates there has been adopted the following normative legal acts:

On Attorneys’ activity there has been adopted the following normative legal acts:

The law of the Republic of Uzbekistan “On advocacy” in the new edition;

Changes in the Law of the Republic of Uzbekistan "On guarantees of advocate activity and social security of advocates”

The law of the Republic of Uzbekistan "On psychiatric care", providing the right of persons with mental disorders, who are receiving mental health care, to get the legal assistance of an advocate;

The law of the Republic of Uzbekistan "On the appeals of people and legal entities" in the new edition, which includes the right of citizens to get the legal assistance of an advocate while considering appeals of the state agencies;

The law of the Republic of Uzbekistan "On the prevention of child neglect and juvenile delinquency", which includes the right of advocate to participate in the consideration of applications on premising the juvenile in the centers of social and legal assistance;

Changes in Criminal procedure and civil procedure codes of the Republic;

The law of the Republic of Uzbekistan "On detention during criminal proceedings";

Resolution of the Cabinet of Ministers of the Republic of Uzbekistan "On measures of improvement of the payment mechanism for legal aid the provided by advocates’ at state expense" dated June 20, 2008, №137;

Resolution of the Ministry of Justice and Ministry of Finance of the Republic of Uzbekistan "On approval of the regulations on the procedure of attributing to the state the costs of providing legal assistance to the suspect, accused or defendant” – dated 26 November, 2008, №8, 109;

The order of the Chairman of the Chamber of advocates of the Republic of Uzbekistan "On approval of methodical recommendations on conducting attorney production (file)" dated November 12, 2010 №3kx;

 

In the result of the reform of advocacy, in the framework of judicial and legal reforms of country, organizational bases of the legal community as a whole were conformed with the norms of international standards.

 

What assistance is provided to the lawyers in the Chamber of Advocates:

Chamber of advocates worked out the provisions about methodical councils of the Chamber of advocates of the Republic of Uzbekistan and its territorial offices.

The main objective of the Councils is to increase the efficiency of the execution of duties imposed to the Chamber of advocates in accordance with article 12-2 of the Law of the Republic of Uzbekistan "On advocacy" regarding task of representation and protection of rights and legal interests of advocates, including in relations with bodies of state and economic management, as well as in court; to take measures to protect advocates from persecution, restrictions and encroachments in connection with their professional activities

 

The magazine "Advocate"

The popular scientific, social-legal magazine "Advocate", that founded by the Chamber of advocates of the Republic of Uzbekistan plays a big role in the legal propaganda aimed to improve the legal culture of the population.

In accordance with the Concept of development of legal journals in the Republic of Uzbekistan, approved by the Decree of the President of the Republic of Uzbekistan dated 18.10.2005, DP-203, main tasks of magazine are:

– extensive coverage of the activity of advocacy in the protection of the rights and lawful interests of citizens;

– providing practicing attorneys with the necessary information, regulatory materials, in regard with the provision of legal assistance to the population;

– organization of discussions on the draft legal documents and existing legislation of the Republic of Uzbekistan issues;

– publication of regulatory and international documents relating to the practice of law;

– publication of scientific articles devoted to the problems of improvement of the profession of attorneys.

The magazine has the following regular columns:

"Society and the advocacy", "The Process of reform of the advocacy”, "From the attorney’s practice",

"Lawyer counseling" and etc. The Magazine is primarily intended for practitioners, scientists and experts, teachers, master students, undergraduates and other judicial workers, as well as for everybody interested in advocacy.

The magazine regularly publishes articles by leading advocates of Uzbekistan on the most common practice in matters related to the protection of rights and freedoms. The magazine is published in Russian and Uzbek languages.

 

Qualification Commissions of the Chamber of Advocates

Article 12-2 of the Law "On advocacy" monitoring compliance with the law by lawyers, Rules of Professional Ethics of Advocates, attorney-client privilege and the attorney assigned to the oath of the Chamber of Advocates of the Republic of Uzbekistan.

In accordance with Article 13 of the Act, conduct disciplinary proceedings against lawyers assigned to the qualification commissions created under the territorial departments of the Chamber of Advocates.

The qualification committees are joint decisions of the territorial department of the Chamber of Advocates and the judicial authorities of an equal number of lawyers and judicial authorities.

To appeal the decisions of the qualifying commissions, synthesize and analyze practices of qualifying commissions formed in the Chamber of Advocates Higher Qualification Commission. The composition of the High Qualification Commission approved by a joint decision of the Chamber of Advocates and the Ministry of Justice of the equal number of lawyers and the Ministry of Justice.

Conference of the Chamber of Advocates of the Republic of Uzbekistan have been approved by the Rules of Professional Ethics of Advocates, which states that in order to enhance and preserve the credibility of the professional lawyer should act within the framework of morality and not to commit degrading acts.

 

Free legal assistance

In accordance with Article 116 of the Constitution, "the accused is guaranteed the right to defence.

The right to professional legal assistance is guaranteed at any stage of investigation and legal proceedings. Legal assistance to citizens, enterprises, institutions and organizations, the advocacy acts. Organization and procedure of the bar are determined by law."

Article 51 of the Criminal Procedure Code of the Republic of Uzbekistan establishes cases where participation of defence counsel in a criminal case is obligatory.

Thus, the participation of defence counsel is mandatory for:

1) Minors;

2) the mute, the deaf, blind and other persons who due to their physical disability or mental illness have difficulty in the implementation of the right to defence;

3) Persons who do not speak the language of the proceedings;

4) Persons suspected or accused of a crime for which the punishment as may be assigned to life imprisonment;

5) persons between the interests of which there are contradictions, if at least one of them has a defence counsel;

6) Which involve the state or the public prosecutor;

7) In which the lawyer is involved as a representative of the victim;

8) On the application of compulsory medical measures.

Investigator, prosecutor and the court may recognize the necessity of the defence, and in other cases if they believe that the complexity of the case and other circumstances may hinder the suspect, accused or defendant to exercise their right to defence.

In accordance with Article 50 of the Code of Criminal Procedure, at the request of the suspect, defendant or the defendant's participation in the defence provide the inquirer, investigator, prosecutor or court.

Investigator, prosecutor or the court, in charge of the case, have the right to release the suspect, accused or defendant is fully or partially from payment for legal assistance.

In these cases, labour costs are counsel to the State in the manner determined by the Cabinet of Ministers.

The payment mechanism provided by legal aid lawyers by the state determined the Cabinet of Ministers of the Republic of Uzbekistan June 20, 2008, № 137. In accordance with the Decree:

– the basis for attributing the cost of providing legal aid counsel to the suspect, accused or defendant to the State is the decision of the inquirer, investigator, prosecutor, the court ruling on the release of a citizen to pay for legal assistance;

– exemption from payment for legal aid lawyers, with such costs to the State shall be persons in families where the average total monthly income attributable to each member of the family does not exceed 1.5 times the minimum wage established on the day of judgment, (definitions) exemption from payment for legal assistance;

– at the expense of the state also include the costs of legal aid in cases of a lawyer in the proceedings connected with the refusal of the suspect, accused or defendant from the defence attorney, as well as in cases where, in accordance with the second part of Article 52 of the Criminal Procedure Code of the Republic of Uzbekistan participated defender in the criminal case considered mandatory.

Pursuant to the said Resolution of the Cabinet of Ministers, a joint decree of the Ministry of Justice and Ministry of Finance of the Republic of Uzbekistan approved the Regulation "On the procedure for attributing to the State the cost of providing legal aid lawyers suspect, accused or defendant."

Currently, there are three main criteria that are the basis for attributing the cost of providing legal aid in criminal proceedings at the expense of the state:

– the property status of the accused, the suspect, the defendant, who wants to take advantage of the legal assistance of a lawyer in a criminal case;

– Involvement of a lawyer in legal proceedings related to the refusal of the suspect, accused or defendant from the defence;

– the reluctance of the suspect, accused or defendant to conclude an agreement (contract) to provide legal assistance to the defence, provided that the participation of defence counsel in the case necessarily in accordance with the law.

 

Work on legal advocacy

Chamber of Advocates is involved in organizing various activities to promote legal propaganda in the form of seminars, workshops, round tables and conferences in cooperation with other law enforcement agencies.

Moreover, Chamber of advocates covers the advocacy activity in mass media, including newspapers, magazines, TV and radio, official web-site of Chamber of advocates. For example, citizens and legal entities obtain answers to questions of their interest on interactive TV programmes.

Chamber of Advocates actively participates in various events, such as seminars, conferences, round tables and others, organized by in cooperation with other law enforcement agencies (the Supreme Court, the General Prosecutor's Office, Police Academy, Ombudsman and others.), non-profit organizations, universities (Tashkent State University, the University of World Economy and Diplomacy), Lawyers training Centre at the Ministry of Justice of the Republic of Uzbekistan and other organizations.
